Unrentables was created to provide helpful information and insight into
the challenges we face as renters and landlords.

EDITORS NOTE
As a business owner and a renter, im outraged that this decent landlord had to endure this,

I feel its the courts are responsible for this damage along with his state reps along with law enforcement that turned thier backs on written laws.

denying Landlords the rights afforded to them by our bill of rights and our constitution.

Please if you are a  renter/tenant. , land owner aka landlord. We must stand together agaisnt this scam. why didnt the gov demand walmart give away food or necessities or that other retailers also do it? why did they choose to rod law abiding tennants and landlords?

I feel as if its all about division. Now landlords are with in thier right to refuse anyone at any time a rental in fear of losses amassed by this bullshit pandemic excuse.

How many state employees that were landlords were denied the right to remove non payers. Its just you wont hear of it cause the media has a code blue policy to not mention such cases to the public.

The time is now, as of now there wont be a tomorrow or a later date for renters as landlords have expenses also. I want my landlord to flourish as hes a hard working respectable guy for one thing.

And as a past business owner I believe profit is not a dirty word.
If I was a landlord Id take any application and remove the word "race as a question. Id demand some stability for at leats a 5 to 7 year period of thier life.

Id also verify means of paying rent. and Id demand a list of 3 nighbors from previous places of residence, "if possible" in place of references.

Id also ask for police agency phone numbers for the residences they held and Id verify of any police calls.

as to convictions, I would await to become the home owner where a perp is finally busted after years of evading criminality.

My wife and I during the pandemic paid our bills even after the law closed down my place of. employment.

One thing as Americans were Citizens not victims. We will push when they try to shove WE WILL NOT REMAIN SILENT

Judicial Misconduct is plagueing our Housing courts we must Abstract from using these institutions.
Arbitration is the answer
PictureObedience to law
The Only Solution is to not   even  use the court. Use other   resources thate are just as
 legal and binding

Landlord-tenant disputes can be resolved through arbitration, except when they are covered by specific forum created by rent control laws, the Supreme Court has ruled. Delivering its landmark verdict in the Vidya
Drolia and others versus Durga Trading Corporation case, which will pave the way for speedier dispute resolution, the top court has held that arbitral tribunals have the power to decide such cases under the Transfer of Property Act, 1882.

However, for these disputes to be resolved through arbitration, the rent agreement must have an arbitration clause—this means the decision to include a clause to this effect in a landlord-tenancy agreement lies with the parties concerned.
Arbitration as a means to resolve rental disputes..
The rise of arbitration can however, offer a new avenue to settle disputes. An arbitrator is a person (usually a lawyer or retired judge), whom the parties can appoint by mutual consent, to hear and decide disputes among them. If the parties insert an arbitration clause in the contract and specifically name a person to act as the arbitrator, it will be valid and binding under the Arbitration and Conciliation Act, 1996 (also referred to as the Arbitration Act).
For the uninitiated, arbitration is a process in which the contracting parties mutually opt for a private dispute resolution procedure, instead of going to court, in effecting saving precious time and resources. The decision of the arbitrators is binding on all parties.  According to the latest SC order, the decision by the arbitrator can be executed and enforced like a decree of the civil court.  Read More Here

 An Alternative to Traditional Litigation:'
Arbitration offers alternative dispute resolutions and is an alternative to the lengthy and often costly pretrial discovery required in the failed court system, as well as the uncertainty long and frustrating trial. The principal advantage of Arbitration is its inherent flexibility, giving the parties and their attorneys the abArbitrations offer the following results.
  • Mediation:
Mediation is a voluntary, confidential process in which a neutral mediator assists the parties in identifying and discussing key issues in dispute, exploring various solutions, and developing a settlement that is mutually acceptable to all parties. The mediator has no authority to impose a settlement and the parties are under no obligation to reach agreement.  Mediation proceedings are private and confidential and the substance of the discussions in mediation is generally considered privileged.  Mediation can be used to resolve every type of dispute, including conflicts that have not yet resulted in formal litigation.
  • Arbitration:
Arbitration is a process in which a neutral arbitrator, or panel of arbitrators, issues a binding decision on a disputed matter after a hearing is conducted in which the parties (or their representatives, often attorneys) present evidence and arguments to the arbitrator(s).  This process most closely resembles a trial in the courts, although in most arbitrations, the rules of evidence are relaxed, there is limited prehearing discovery, and the process is typically quicker from beginning to end.  The award of the arbitrator, except in limited rare circumstances, is final and not subject to appeal.
  • Case Evaluation:
Case evaluation is a process in which the parties or their attorneys present a summary of their cases to a neutral who then renders a non-binding opinion regarding the settlement value and/or likely outcome if the case were tried in a court or in an arbitration proceeding.  This process is often used to encourage settlement discussions, and the neutral is typically a well experienced attorney or retired judge whose opinion will be respected by both sides of the controversy.
This is such a easy fix.
We as citizens demand Law and Order,

If you are driving on the Mass Pike and you see a situation where your legally justfied to take a specific action and you decide to do so, Should you be penelized by a Police officer cause you hurt the feelings of someone that is in a uniform respresenting the state?

If not then why do you feel it is ok to be out the monies your

rightfully entilted to because of a law clerk who is really an

Remeber being a high schooler getting your first job at a burger joint of supermarket?

You missed a shift for a school function and they docked your pay. or you seen fellow workers let gop for poor unacceptable performance. Do you feel its fair you pay these people through forced taxation and they treat you like the rag

you have in the dish room?

It is time we changed this
travel path in life. Its time we flip the tables on them. I am asking for the landlords to join me in doing a state wide

 reform of the housing courts.

We need to have people replaced. Not transferred cause if they have no intellect of the job they are doing then they should be removed. This isnt a task of putting ketchup on a bun or carrying out a bag of groceries for a senior citizen.

This is a serious issue. you as landlords are on the hook for the losses incurred cause of the il faded actions of these actors

posing as court staffers.

We must also admit to ourselves that the legislative body is no longer a judicial branch and they must be replaced also

sounds like a lot of work but how many landlords are in mass, how many legislators are there and the politiacl Party does not matter. If we get just 10 landlords from each city's and town's  theres 351 of these citiy's and towns in Mass  it gives us 351.  plaintiffs and residents will jump on board because we too are the victims that will suffer the most in the long run. possibly on low estimates its 7000 plaintiffs

We need this to grow and we need this to be triumphant.

WE will follow all laws and have recent ill faded laws removed.
we will call this the.

Plan Of Attack

Unfunded Eviction Moratorium
Eviction Videos
When these Eviction Moratoriums Began they were unfunded. Thousands of landlords took the issue to court rightly saying that the  Moratoriums are unconstitutional.

The state cannot require someone to house tenants without a Payment or to pretend that if they stopped paying for 6 months somehow they will repay us later. It’s not rocket science.
its "Trickle Down Economics", and we know that there is no such thing as "Trickle Down Economics"
However, by the end of 2020 and beginning of 2021 America as a whole came to the collective understanding that if there will be Eviction Moratoriums they need to be funded.

On 12-27-20 the Federal Government allocated $25 billion dollars for landlords to get paid and on 3-11-21 it allocated another $21.55 billion. Sadly, only about 11-12% (that’s about $5.5 billion out of $46.5 billion) have been distributed so far. As of today it might be 20%. The reason for that.
But, no, they even wanted to lengthen the time of not being able to file stating in court that if they let landlords legally file again, this will cause the clerks to have to work cause of the filings.

when in reality the tsunami was created SIMPLY CAUSE landlords were ilegally stopped from filing in the first place, and extending that will created a even bigger work load of filings and bottlenecks the Courts.
